East Bay Dog Walkers Pet Sitting Agreement
Owner understands that pet care services involve inherent risks, including but not limited to illness, injury, escape, property damage, or unpredictable behavior of animals, even when reasonable care is exercised.
By engaging East Bay Dog Walkers, Owner knowingly and voluntarily assumes these inherent risks associated with pet care services.

By signing this agreement, the client (“Owner”) agrees to the following terms:

1. Cancellation Policy
Dog Walks:
Cancellations must be submitted through the client portal at least 24 hours in advance to avoid charges. Cancellations with less than 24 hours' notice must be communicated via text to Mona at (925) 403-1218 and will be fully charged.

Boarding, Overnight Stays, and Pet Sitting:
A 20% cancellation fee will be applied regardless of notice given.

2. Surcharges
Additional surcharges may apply based on scheduling, notice, or holidays. These include:
Time of Day: Services scheduled before 8:00 AM or after 8:00 PM may incur a surcharge of up to $9.
Holiday Surcharges: Christmas Eve, Christmas Day, New Year’s Eve, New Year’s Day, and Thanksgiving: up to $30. Other recognized holidays: up to $10
Weekends: A surcharge of up to $9 may apply.
Last-Minute Requests: Services requested with less than 24 hours’ notice may include a surcharge of up to $6.

3. Access and Security
East Bay Dog Walker is not liable for any incidents involving the home or pet if access is provided via a key left under a mat or any unsecured location. It is the Owner’s responsibility to ensure that the home is secure and, if using such access methods, that security cameras are in place.

4. Care Instructions
Owner agrees to provide all pet care instructions in writing through the online portal or visit notes section. Any changes to instructions during ongoing services must also be communicated in writing.

5. Veterinary Emergencies
If a pet becomes ill during a scheduled service and needs medical attention, the Pet Sitter has the authority to seek veterinary care at their discretion. The Owner is fully responsible for all medical expenses, including reimbursement for any costs paid by the Pet Sitter.

6. Off-Leash Liability
If Owner authorizes off-leash activity or unsupervised outdoor access (including doggie doors or unsecured yards), such authorization is given at Owner’s sole risk. East Bay Dog Walkers shall not be responsible for incidents arising from such access unless caused by gross negligence.

7. Substitute Care
In the case of an emergency, illness, or unavailability, the Owner authorizes East Bay Dog Walker to arrange for another qualified caregiver to provide the scheduled services.

8. Vaccinations and Liability for Injuries
It is the Owner’s responsibility to ensure that their pet is up to date on all vaccinations. Owner represents that their pet has no history of aggressive behavior unless previously disclosed in writing.
Owner accepts full responsibility for any injury or damage caused by their pet to people, other animals, or property during the service period, and agrees to cover any resulting costs or claims, including those made by third parties.

9. Liability Disclaimer
East Bay Dog Walkers agrees to provide services with reasonable care and sound judgment. However, Owner acknowledges that animals can behave unpredictably and that outcomes cannot be guaranteed.
To the fullest extent permitted by California law, East Bay Dog Walkers and its caregivers shall not be held liable for injury, illness, loss, or damage to pets resulting from causes beyond the reasonable control of the caregiver, including but not limited to interactions with other animals, environmental conditions, or the pet’s own behavior.Owner agrees to indemnify, defend, and hold harmless East Bay Dog Walkers, its owners, and caregivers from any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to the pet’s behavior, health, or actions during the service period, except to the extent caused by gross negligence or willful misconduct.
